Stamp Duty
Stamp Duty is a mandatory government tax levied on legal documents, most commonly property conveyance deeds, to provide them with legal validity. It is calculated as a percentage of the property's transaction value or its government-determined circle rate, whichever is higher, and must be paid to the state revenue department to finalize ownership transfers.
Stamp Duty serves as the primary mechanism for state governments to formalize real estate transactions and generate public revenue. In the Indian real estate market, the duty is a critical component of the total acquisition cost, often significantly impacting the financial feasibility of both residential and commercial investments. Because rates vary by state, property type, and the gender of the buyer, understanding these specific fiscal obligations is essential for accurate budgeting and ensuring the enforceability of a property title in a court of law.
In practice, the duty is paid by purchasing non-judicial stamp paper or through an e-stamping portal before the registration of the sale deed. Buyers must ensure the correct valuation is applied, as underpayment can lead to penalties or the impounding of documents by the registrar. Once paid, the receipt or stamped document must be presented during the formal registration process at the sub-registrar's office.
